2. Scope

These Terms and Conditions apply to all purchases made through this website, including online courses, ebooks, masterclasses, reflection questionnaires and individual guidance sessions. By completing a purchase, the customer declares that they have read and accepted these terms. Purchases are intended for people aged 18 or over.

3. Nature of the content

The courses, ebooks, questionnaires and sessions are for educational and informational purposes only. They do not constitute a psychological assessment, diagnosis, therapy, legal advice or clinical support, and they do not replace the involvement of psychologists, doctors, therapists or lawyers.

Heloísa Oliveira is not a psychologist or a doctor. Whenever a child's situation justifies it, we recommend contacting a qualified professional.

References to legislation are general and may not reflect changes made after the content was published.

4. Products

  • Online courses and masterclasses: video lessons and support materials, available in a members' area.
  • Ebooks: digital files to download, usually in PDF.
  • Reflection questionnaires with a report: online, non-clinical questionnaires that generate a personal report. They are not a psychological assessment or a diagnosis, and they do not identify high ability or any other condition.
  • Individual guidance sessions: online video sessions, with the duration stated on the product page.

5. Prices and payment

Prices are shown in euros and include VAT at the applicable legal rate. There are no additional delivery costs, as all products are digital or provided online.

Accepted payment method: credit or debit card. Payment is processed by Stripe, a secure payment provider, and Surprise Sphere does not have access to full card details.

An invoice is issued in the customer's name and sent by email after payment. If you need an invoice with a tax number, enter it in the purchase form.

6. How to purchase

  1. The customer chooses the product and fills in their details in the purchase form.
  2. Before paying, the customer sees an order summary with the total price and can correct their details.
  3. For digital content, the customer indicates whether they want immediate access, as described in section 8.
  4. By clicking the payment button, the customer accepts the obligation to pay.
  5. The contract is concluded when the customer receives the confirmation email, which includes these terms, the purchase summary and, where applicable, confirmation of their consent to immediate access.

7. Access to the content

Access is sent by email immediately after payment is confirmed. Courses are available for 12 months from the date of purchase. Ebooks can be downloaded and kept by the customer.

To access the content you need a device with an internet connection and an up-to-date browser. Videos do not work offline. PDF files require a PDF reader, available free of charge.

Individual sessions are booked by email or through the scheduling tool indicated, and take place on Google Meet, with a link sent by email. No software installation or account is required.

8. Right of withdrawal

For distance contracts, consumers generally have the right to withdraw from the contract within 14 days, without giving any reason and at no cost, under Portuguese Decree-Law no. 24/2014.

Courses, ebooks and other digital content

The 14-day period starts on the date of purchase. The consumer may ask for immediate access. In that case, and only if they have given prior, express consent and acknowledged that they lose the right of withdrawal, that right ends as soon as access to the content is provided. Consent is given through a separate, unticked box in the purchase form and confirmed by email.

If the consumer does not tick that box, they keep the right of withdrawal for 14 days, and access to the content is only provided after that period ends.

Individual guidance sessions

The 14-day period starts on the date of purchase. If the consumer expressly asks for the session to take place before the end of that period and then withdraws, they only pay the proportional amount for the service already provided. If the session has been fully provided, at the consumer's express request and with their acknowledgement that they lose the right of withdrawal, that right ends.

Regardless of the right of withdrawal, sessions can be rescheduled free of charge up to 48 hours before the appointment.

How to exercise this right

Simply send a clear statement to ola@heloisaoliveira.com, for example using the model form in the Annex. Refunds are made within 14 days of receiving the request, using the same payment method as the purchase unless otherwise agreed, at no cost to the consumer.

9. Conformity of digital content

Digital content must match the description on the sales page and work as stated. If it does not conform, the consumer has the rights provided for in Portuguese Decree-Law no. 84/2021, including having conformity restored and, in the cases provided for, a price reduction or termination of the contract. Any technical problem can be reported to the email address in section 1.

10. Copyright and use

All texts, videos, materials, trademarks and images on this website and in the products are protected by copyright. A purchase gives the customer a personal, non-transferable licence for their own and their family's use. Sharing access, recording, copying, reselling, publishing or distributing the content, in whole or in part, without written permission is not allowed. In case of misuse, access may be suspended, without prejudice to other legal remedies.

11. Liability

Surprise Sphere strives to keep the content accurate and up to date, but decisions made on the basis of it are the responsibility of those who make them. Nothing in these terms excludes or limits the rights consumers have under the law.

12. Personal data

The processing of personal data is described in the Privacy and Cookies Policy.

13. Complaints and dispute resolution

You can send any complaint to the email address in section 1. You can also use the Portuguese Electronic Complaints Book (Livro de Reclamações Eletrónico).

14. Applicable law

These terms are governed by Portuguese law. The choice of law and jurisdiction does not deprive consumers of the protection guaranteed by the mandatory rules of the country where they live.

15. Changes

These terms may be updated. The version that applies to each purchase is the one in force at the time of purchase, sent to the customer in the confirmation email.
